Sample Teaching Contract for Dispatch Company

Just thought I'd share with you all one of my past contracts. The contract was for a dispatch company in Tokyo and I was sent to various companies to teach English in the evenings. Sometimes there would also be intensive classes during the daytime for 5 or so consecutive days.

Anyway, take a look at the below contract that was issued to me.

---------------------------------

Whereas Excel international Co., Ltd. (hereafter referred to as EICO) provides language training for its clients. John Citizen the instructor, agrees to cooperate with EICO in realizing this goal, therefore, both parties agree to conclude this contract under the terms and conditions listed below.
  1. This contract shall be applicable to the following courses:
Course Name: Kyouwa Hakko, k.k. (middle level)
    Contract Period: Dec. 11th, 2004 ~ June 4th, 2005.
Teaching day and time: basically every Saturday from 9:30am to 12:30pm, totally 20 days designated separately within the said period (3 hours / day).
Teaching location: Kyouwa Hakko meeting room.
  2. Your teaching hourly allowance is 4,000 yen.
  3. EICO wil pay your actual transportation expenses. Car and motorcycle rates are calculated separately on a fixed basis of 20 yen / km for cars and 10 yen / km for motorcycles. Toll fees and parking charges will not be paid.
  4. You are required to follow the rules of the office and the instructions of management.
  5. If you need to cancel a class, 24 hours notice is required. 48 hours, however is preferred.
  6. You will maintain a professional appearance, attitude and performance.
  7. Basically, you select materials by yourself, but we recommend that you use the materials provided by the office.
  8. You will maintain class record reports at every class to the coordinator's and management's satisfaction.
  9. EICO will make a visit to your class if necessary, and give you some advice and suggestion to achieve good result.
  10. This contract is valid only if you have obtained an appropriate visa, and only while such visa is valid.
  11. Either party has the right to terminate this contract before it expires, provided that one party informs the other 30 days in advance. Failure to provide at least 30 days notice may result in the whithholding of your allowance.
  12. This contract begins on: December 11th, 2004 ~ June 4th, 2005.
  13. Failure to follow any of the aforementioned will be grounds for termination.
Date: December 8th, 2004.

Contract is almost in the favour of Employer. I do not think so that they are thinking of you while making contract. The teaching allowance they providing is low as compared to market rate. Its better to not to accept this contract.

I agree, it looks as though they have you right where they want you. If I were you I would really have someone look over that before you sign, if you have not already.
