Slick Smith in Japan (letter from Mark)

First conversation is about buying a Diving company in Brisbane Australia.
This email is in April of 2003 from Mark.. before coming to 'study' with him.

---------------------------------------------------------------------------------
(Mark)

$1.200.000 is not a large amount of money and of course I don't know about it. Shall we do a business plan on a buy out? Save us building it up from scratch if it worked out? But Scotty this is as I suspected.

Big business, waiting for business people instead of divers. Now most business people are too busy doing business to study diving and see what we have seen. Now a buy out like this is a difficult negotiation.

Done right it can be win win. Done wrong...well a beginner would lose his money and me, well I would lose the opportunity as I walked away.

But if we could pull down the business and grab the set up then force feed it Japanese Divers...mmm could be fun. There are several approaches to Steve. I will discuss these with you when I see you. Remember, the aim is to make money for us and keep Steve satisfied. We have ways my friend.

Mark.

You have just touched on what I have been thinking about for the last couple of months. Ref Scuba/Japanese and business..Anyway, as you will discover when you come to Brisbane, Businesses run by divers. The Monopoly of the brisbane system for openwater/advanced divemaster and instructor courses is far and away won by xxand xx xx of xxxx brisbane (as you know a franchise, with outlets in cairns, airlie beach, mackay, brisbane, sydney ,hongkong, fiji, vanuata etc).

BIg PADI sales push every time you walk thru the door, and xx and xx train their full time staff to push very hard. They have been in the industry for far too long and if not for xxx (General Manager), a lot of staff would not stand to work for them, due to their attitude and lack of real management skills. Basically, they treat their staff like children. xx and xxx own numerous properties and commercial real estate, and basically are still working because they haven't been able to sell (on the market for some time) xxx brisbane/bulimba and the xx boat. They negotiated with xx xx (xx, to sell for 1.2mill recently he told me, so you don't know about it. Basically, while the courses are good, I'm looking forward to going to japn to learn some real world skills.

More later, scotty

I just read through this again and it is still agreeable. I have kept a large pice of actual teaching work at Kyobashi under part time teachers so as to be able to plug you in when you get here.

I have also reassigned Donovan back into the Kyobashi environmet as in his capacity as CEO he has lots you can learn in respect to the day to day of the business. Morimoiya and Senri Yama schools were good management opportunities but they both sold and so we will need to look at other projects you can sink you teeth into as well as Kyobashi.

I am also thinking of researching the dive profession at a little more serious level. The Japanese are keen divers and love Australia but from my vantage point I see very little in the way of serious effort going into capturing this market. In fact the diving industry in general seems to be run by Divers not business men. If so there is business in there. As we both share an interest in diving that may also be worth a research project and the building of a business model as part of the training within the mentorship.

Hope the family and the business are travelling well. On the weekend just got to the 61dives, was on a liveaboard for 3days, great experience and the most testing conditions yet to date with current.

Dived to 41 metres on the "St Paul" wreck off the coast of Moreton island. Almost lost two people in the current who couldn't make it back to the deco bar. Only the instructor and i got back to the ship, then back on deck, he promptly spewed everywhere and went to bed with a migraine. Seadog that he is....Was diving also with a xxx captain who motivated me by his conversation that i dont' want to be in the same position as him. Almost broke my hand as well, with a rachet at the back of the boat, yet all in all a good experience. Reference the written/verbal contract with the mentorship program, are we still
with the version below?

Hope all is well, scotty

They tell me the master is the one course which breaks the back of the study. From there on it's plain sailing and those mandatory 100 tanks till you called a licensed instructor.

I must say I am glad to see the approach you are taking to the business in Japan. I will hereafter outline our discussion.

1. You will arrive in June 2003. We can be a flexible on the start up within reason.

2. You will enter into a mentorship program run by myself. The focus of the mentorship program will be business management.

3. You will employ the skills taught on the mentorship program within a practical environment. This environment will be the Kyobashi head office school. You will take on the Profit Share Teachers role. This role requires the leading of the head office teaching team. Main concerns are to the marketing and supply of a quality product. Kyobashi will be a perfect enclosed and safe environment to test out your skills and make some money for yourself and the company. To increase the turnover at Kyobashi will be to increase your income. Help and support will never be further than the corner office away.

4. The mentorship program tied to the Kyobashi head office PST agreement will place you at the hub of the company and it's information. It is agreed for now that we do not know where this information and the opportunities it will provide will take you.
This company and it's subsidiaries grow too fast to focus on any one positionfor your future today. In other words, get the skills, get comfortable, look around and decide.

5. The price for the mentorship program will be JPY1,000,000. This will be paid upon agreement to go ahead. Mutual commitment. I must commit my schedule and path the way to your entry in Kyobashi. In return I ask you to commit with your payment. We are bound to go ahead together from then on.

Please reply by return email to confirm or amend and we will draft
up an agreement, proceed to payment and then look forward to June.

Smith's Slick Operation in Japan

This is the email sent to my from Mark Smith after I quit on the 14th of Feb 2004. The next day he had 2 threatening Japanese male goons sent around to the apartment in Morinomiya in which I lived at the time.

Hi Scotty,

Still no contact from you and no idea where you are. I have asked xx to put me in touch with you and he simply keeps you information confidential. I respect that in because in an effort to get past xx
to be allowed to communicate with you directly I have been quite
harsh on xx.

He has been under terrible stress refusing me information
whilst knowing your contact details. He is a rock and will not release
any information as to your whereabouts. You have a good friend. I
think putting him in such a position is a bit naughty of you and
rather immature and unnecessary. Men should talk to each other. You need to contact me.

Emiko said you called and left a cryptic message. Something like "i
will see you" This scared her and I am asking you not to do that
again. Our staff as you know are all Japanese females and tend to scare easily. When you call in again please ask to be transfered to either Yuka or I.

Whist you have been away.
- I have terminated the use of your telephone hardware. I would
appreciate it of you would bring back the hardware to the office till you are ready to go again. I have maintained the account and have
been running a ghost on it which now becomes the main unit. Quite happy to pass this back over to you when you get back in to handling some of the work I still ready to offer.

- I have diverted your emails to my account and am maintaining a
watch. I am not terminating the address at this time.

- I have had to replace you as a teacher on Wed and Thursday. That
was a bit tricky due to the sudden nature of your departure. Even had me
back in the classroom! And I signed a trial! What a laugh.

But we have it covered now and all is well. I guess the good news on this
point is when you do come back I have no classroom work to offer. You
would be pure sales and franchise installation. As you know that's
where the best money is too.

- We have closed a total of seven new franchise sales in these last
weeks. What a blast. Of corse as I closed them I get to keep the
commissions. A share of that could have been yours Scotty. That is 9
new franchises coming in before August. (15,000USD x 9 = 135,000USD + 450,000 yen / month increase in turnover)

Now it didn't help that you left xx in the xx and we lost that one but apart from the embarrassment and minor scratch to our professional reputation we will be fine.

I am still living in hope that you will want to take a new role in the installation of these new franchises. Of course as every day goes by I need to allocate human resources to cover this responsibility.

Get back to me ASAP.

Derek is working like a Trojan. You would be very proud of his
advancement as a sales person. I know you saw the start of the study
he undertook in this pursuit and so I am sure if you saw his efforts
you be surprised at just how quickly he has learnt.

I am sure he is going to close his first full franchise sales within the next days.

We all know he could be done with the commission. Just hope he doesn't leave like you the day after he picks up the 500,000 commission. Just
joking mate. I am sure he will stay with the team.

- The new sales staff on the desk at Kyobashi are running at above
80% sign ups from calls this month. Our newest girl who doesn't even have a month with us yet just signed up a "man to man" as her first
success. What a team. (Together Everybody Achieves More)

- Looks like we sold Katsura. It's not 100% but looks good. 2,300,000
cash. I am surprised at that. But hey everyone is different and this
investor sees the gold in that location. Will be set up as a profit
share situation. I will be glad we move that one. Davo has been
getting a bit anxious. Perhaps eevn doubting the system. As you know
it wasn't an easy sale, one guy even ran back to Bankok!

Ok mate thats about it. Now the two things that I did mange to
squeeze out of xx were that he doesn't think you will be hanging around Osaka. Maybe even heading to China and that you have told Peter not to come to Smith's. I hope these are both just part of your smoke screen and that both you and Peter will be a part of the TEAM at Smith's.

Come on back Scotty. The work is great. the company is growing and
the success is a buzz.

Mark.

ps. xxxxx has said her first words. When I show her your photo she
points away and goos and gaas big time.

pps. xx dropped in a great photo of you and the team. We all want
to get back to that joy shared in that photo.

To stop being alone and come in and see me.

Next email.............Mark getting desperate.

Dear Scotty,

Still no word from you. That's not good.

On a positive note. Yesterday turned out to be one of our best
seminars ever. We confirmed another franchise sale, took orders for 3
new sets of Craig's expanded curriculum and new new web sites. I am
sure you would of have enjoyed it. Thee positive atmosphere was
literally humming. Craig is getting really good at presenting his
curriculum and it is good to see him making some real money after the
years of work he put into building the curriculum. I am very proud of
him.

Actually I had a gut feel you may turn up at the seminar and in your
present state of mind, (according to feedback from your friends) that
would not have been very good at all. It seems that anyone who is
upset in any way with Smith's targets the seminars as a great place
to say what they have to say, to take a poke at me in the most
embarrassing location. Trouble is of course it's not me they would
hurt. I can't allow any disruption of the meetings as the lively
hoods of my staff, my franchisees and our suppliers ride on the success of these seminars.

Anyway looks like I worried needlessly. You didn't show up which is
good news. Glad to see you are a little more mature than those few
other ingrates who threatened to disrupt the positive environment
over the years. Now, having said that, when are you coming in to discuss
you work with Smith's. I am still waiting to hear from you directly
on what is happening.

Looking forward to hear from you.

Mark.

Bearcat I know who I am but I think you are the one with the identity crisis. OK. You asked for it. I hope you don't gamble as you are the worst bluffer I've ever met. As you suggested I contacted Henry of Free-Esl and he sent the following response about you. Please read:

From Henry...
...That Bearcat is the biggest, the most pathetic online fraud I've ever come across. Smithwatch, I can verify that you are the original Smithwatch who created and posted all that content hosted on my site (and took it down later on your own) and Bearcat is just a copycat trying to get some attention. I don't know, but I get the feeling that Bearcat is still angry about not getting a box of Fiddle Faddle snack for his 4th birthday as he rants on and on like a little kid in a stormy tantrum. To what end, know one knows. Smithwatch, although I was sad to see you go I understand that you wanted to move on with things. You made the best blog my server ever had and I see what you did was like a successful retirement. After reading everything about him I totally agree with you that Bearcat isn't even a has-been. The proof is that he came late in the game at freeesl and before hadn't made a single comment. Yes, his nanobit site really sucks. Every time I look at it I almost injure myself laughing. Reviews! That's a real laugh. I mean the site sucks so bad it's not even worth making a bad review about it. It's obvious that Bearcat IS the Admin. Everytime he refers to the nanobit Admin in 3rd person he's lying. It's obvious he's making a futile attempt to do what you did but no one's buying it. What a fraud! Bearcat is not only an online fraud he's also an online parasite. So Bearcat! I verify online that you are the real fraud. Also, please stop sending my all those emails asking me to make up a story saying Smithwatch is the fake. It's annoying and not true so stop it!...

I rest my case. Cheers! From Smithwatch

Still up to your lying I see.

Tell the readers, how can Henry have the same writing style, paragraphing, puctuation as you?

The call was for the readers to verify the information through contacting Henry at Free-ESL. It wasn't for you to post an obvious bogus correspondence between yourself and Henry. The readers have the ability to verify it independently. That was the whole point.

The fact that you'd even attempt to pull this shows readers even more that what you're doing is lying and as well serves to prove just how much of a ripoff job Smith and his group are.

Look, you've been doing this impostering now across many forums for quite a while now. Its not having the effect you wish it to. In fact, quite the opposite.

Smiths School Ripoff in Japan

Mark's Philosophy about Foreigners working in Japan.

"They are fruitpickers, and deserve to be picked"

He figures that the average foreigner in Eikaiwa in japan spends an average of x time here. Therefore, during that time, they have a lot more surplus cash then they would have in their own country.

That surplus cash could be put to better use by investing in Mark's proven system of making business through franchising a quality English teaching system in Japan.

50,000 yen a month, about 480USD a month (by bank transfer) from each 'fruitpicker' to BUY BUILD SELL a quality 'franchise' in Japan.

Now, having been a fruitpicker myself (in his system) I know that there is a major substantial difference between what is said to a 'fruitpicker franchisee' and what Mark really thinks and wants.

What does he want? simple

15,000USD and 50,000 yen a month from each fruitpicker until they give up (or on the rare case sell) their franchise school.

What does he say? simple

If you invest in me and my company, the largest and fastest growing franchisee system in English in Japan, you will have the ability to 'Buy Build and Sell' your own business in Japan.

You will have full support from 'Head Office'...(truth is Mark is lucky to go there once a month now), so that really means 'up yours' after your money is paid to Mark's account.

Smith's School of English in Japan

Hi Ladies and Gents,

Recent requests from some current franchisees via private email have brought this business solution for Mark Smith up.

Currently there is approximately 45 people paying Mark Smith 50,000 yen a month each through Smith's School of English in Japan via bank account transfer.

We all know that Mark controls his 'Franchisee Meetings' like an army drill parade. The reason being to not allow any 'real' questions from the customers to their service provider (Mark Smith). Mark is terrified of the franchisees learning the fact that if they stand as a united body, at one place and time, they will learn that it is actually THEY who are paying money as customers to HIM

And they have the god-given right to negotiate their contract, particularly as they feel (and many do, especially those in contact with me) that 15,000 USD up front and 50,000 yen a month thereafter DOES ABSOLUTELY NOT represent the quality of the product delivered by Mark Smith.

Over 100people have come and gone in the 10years of Smith's School of English Japan as customers. The first franchisees did not pay anywhere near that money when Mark was bombarding the Kansai Flea Market in the late 90's with his advertising.

Lucky for him that Miles Zonkin sold 10 schools using HPS (high probability selling technique) which got his cash flow happening. Pity for Miles Zonkin that Mark did the dirty on him and didn't pay his 500,000yen in commissions that he promised.

Back to the point.

Mark is concentrating predominately on his Real Estate Investments in Japan Real Estate Investments in Japan His time, money and effort are now all directed in this direction now, as he sees the Japanese Economic Recovery to be the time to get into Real Estate Business.

He's making good money from it. This means he will do bare minimum to keep Smith's School of English "BUY, BUILD, SELL" and the franchisees having their chance for business success.

He has become a ghost at his own company. Being seen only for big sales meetings of the last couple of years.

For the customers reading this forum.

It's time to deal with the dealer. Never try one on one with Mark, but remember in numbers is strength, particularly in a public place.

Save yourselves some money. Tell Mark that from the next payment (as a group) that 5,000 yen a month Franchisee fee will be paid.

This will save you 45,000 x 12 = 540,000 yen a year. Spend this money on advertising etc to build your business.

Mark will have to become his worst nightmare. Honest and hard-working.

He will have to work his company as a normal owner of a company does. Not as a AMWAY legend with a VISA payment system worked into a cleverly designed little niche in Japan.

His company is not getting his time, attention or money. This means as a customer neither will you.

Smiths School of Real Estate in Japan

New Investment Project

The Offer.
We are offering an opportunity for a maximum of four people to join me on a 7 story new concrete apartment development in Osaka Japan. The basic shape will be that 4 finance units of 6.500.000 each will be offered. These four units may end up going to one person and that’ s OK. They may also be taken up by four individuals, equally OK. Either way there will only be four. These four units will earn income in line with that of the building with a minimum guarantee of Return On Investment (ROI) of 5%PA. Apart from the ROI a tremendous benefit of this offering is that it will provide an entry portal to foreigners who want to own their own income producing apartment buildings in the future.

The location.
In Japan river side property still has a long way to go in price. In Australia, America and Europe today it is almost impossible to buy river side land in major cities. In these countries today even if such property does become available only the very wealthy can afford it. Here in Japan this same trend has just started to show, we still have time. Large Japanese companies have purchased premium river side land and built up expensive apartments, hotels and office buildings. This small block of land is priced a bit higher than normal but it allows us access to river side land.
looking across a historic bridge ‘GinBashi’ to the Osaka Mint, Tekoku hotel and further on into Osaka city.
The nights views are truly wonderful.
During the day a 4 minute walk will take you to JR Tozai line.
8 minutes to Keihan Kyobashi,
10 minutes to JR Kyobashi
1 minute walk will take to you to the beautiful Sakuranomiya river side cherry blossom walk
2 minute walk will have you in the grounds of Taikoen.
12 minute bicycle ride will have you at the Hilton hotel or Osaka JR central station.

Finally every year in July each apartment will have a ring side view of the fireworks of the Tenjin Matsuri. We would ask you to consider if you agree with us that this Riverside property sitting in a land sitting in Japan offering such convenience will provide substantial capital gains.

The Building.
This real estate project is to be built on 30 Tsubo or 99.73 square meters of land in Kyobashi, Osaka, Japan. Osaka is the second largest city in Japan and Kyobashi station sees 850,000 people a day. It will be built on a vacant block of land. Total cost will be 145,000,000 yen. Construction will be a steel reinforced concrete building of 7 floors. First floor will be an entrance, mailboxes, trash disposal facility, paid tenant parking and 6 person elevator entrance. Second floor through to the 6th floor will be residential one bedroom boutique apartments. Each apartment will be 29.09 square meters and feature 3.4 meter ceilings allowing lofts and large picture windows overlooking the river view. Separate toilet, bathroom, vanity area will be supplied. Features will include, entrance camera security, automatic lock access from room, two point gas range, air-conditioner, fiber optic cable connection to the internet. Seventh floor will be set up as business space for rent.

The clientele.
Target clientele will be office staff. Nearby recent projects teach us to focus on and expect 60% female and 40% male. The rents will be set to compete with new buildings offering smaller, low ceiling one bedroom units 7 minutes from the main two stations. We have set our prices against one brand new building and another that is a year old. In fact, today we can find no loft style apartments of this size anywhere near the station. Lofts are very practical to the occupant and make the 3.4 meter ceilings give the rooms a spacious atmosphere. Our features, size, green river front location, views, lofts and size will compete well with these buildings today and well into the future.

The Investment.
The project will be built and financed by Mark Smith. He is offering investments ‘lots’ of 6,500,000 to financiers who wish to join him. A total of no more than four ‘lots’ will be offered. ROI (Return On Investment) from operations is estimated at 8% gross. Capital gains on the cost of building are expected and upon sale will be shared on a pro rata basis. Investment lot rights will be transferable to buyers found by owners at no cost. Upon request Mark Smith will seek buyers himself at a brokerage commission of 3%. The building will be managed by Smith and all accounting managed by his office. Cash dividends issued to shareholders on a quarterly basis at a guaranteed rate of 5%. At year end bonuses will be issued in line with the audited year end profitability of the building.

More Information.
For more information on this and other projects contact us today.

Mark's School of Real Estate in Japan

The key to successful real estate investment in Japanese is finding and joining the right team who can lead you through the process making your investment safe, effective and simple.

comment: Mark, if it's as safe, effective and simple as your Smith's School of English, selling VISA's in Japan scam, you are going to make a real killing on the suckers who invest their hard earned money in you.

You need to know they can do the job and you need to know you can talk to them.

comment: Mark, you can't answer any of the questions about the 2,600,000 yen that you've owed me now since Feb 14th, 2004. You've been asked publically by email, phonecall and on forums numerous times. You couldn't do that job, and I was your 'General Manager' until the 14th of February.

Centrally located in Japan, Japan Investment.com has put together just such a team.

comment: Team is you Mark. Just you, same as since you started Smith's School of English. You are the spider in the center of the web.

We are all actual real estate investors with experience in Japan. Each team member lives in Japan and has done so for many years. Our investment team has over 16 years in asset management here in Japan including both real estate and fully foreign owned corporations.

comment: You haven't been managing assets for over 16yrs in real estate Mark. You bought your first house here in Kawanishi when I was working with you everyday in 2003 remember? That was your first investment (through your wife's name) in Japan. It took quite a few banks before the money was loaned to you, as I recall.

Our experience is unique. We work for individuals. We are here for the average real estate investor. We work within safe ranges. We specialize in projects between US$ 50,000 and US$2,000,000.

If you are looking to invest in real estate in japan contact us today.

comment: sure, sounds wonderful, and looks great too Mark (except for your spelling mistakes on your website) Looks as good as your Smith's School of English website that I first saw in Brisbane Australia in 2002. Lucky for you I didn't know, and couldn't see the truth from just your website.
Join us and have your money join and grow together with the money of actual real estate investors in Japan. We know what you need.

comment: Why not stop bragging about how rich you have become by misleading people in Japan Mark? Why not pay back those you owe and clear your conscience, then continue with your business?

Maybe because first your need is a soul.

Thats about it.

Please reply by return email to confirm or amend and we will draft up an agreement, proceed to payment and then look forward to June.

Thank you and kind regards.
Mark Smith.

Scotty, seems like you sure have had a bad experience with Smith. Looks like you are the only one bad mouthing Smith. Don't you think it's enough? I think we all have the message.

Sometimes I wonder about these blacklists. If Smith knew of it, possibly he has some bad things to say about you too Scotty. My mum used to say, "It takes 2 to tango!"
