Tennoji Incident:

Tennoji Tin's Hall is a great pub where foreigners go for a real pub atmosphere and pub-grub.

Just before Donovon became CEO, there was a company emergency. Mark Smith was admitted to 'Intensive Care' and would remain there for the next week.

How did it happen?

Mark was drinking and smoking at Tin's Hall. He was approached by a number of very disappointed and angry franchisees.

They asked for their money back, after being tricked out of it by Mark. They asked once politely.

They were told to "F**** OFF" numerous times by Mark Smith. Once he has the money, it's his and for his use only. It didn't matter what they believed at the time. "F**** OFF"

These words from a man, who has your money and didn't give what he promised tends to agitate at best.

The ex-customers left the bar (it seemed to Mark anyway). They waited outside. Waiting for the chance to seek justice.

'Justice' in a country which to them seemed strange and complicated. Lawyers are very expensive and court takes a long time.

Especially with little evidence and a white face versus a Japanese Registered company.

Their money, invested in good faith, was gone. All gone. There was no other way to turn. They had been f****ed to their face by someone they had trusted.

Mark exited the bar, drunk and happy about denying his ex-customers the money they had requested. "More for me" thought the 'Businessman'....

The ex-customers jumped him. Their money was gone. The cause of their loss and agitation was in front of them. They attacked him and left him unconscious in the street.

Mark was taken to Intensive Care. He spent a week in hospital recovering from the karma of his ex-customers angst. He didn't regret his actions for a second. He confided to people that the 'price of fame' was expensive, and he would continue.

The ex-customers were never sued or pursued in any legal way by Mark Smith. (Though he has told other franchisees differently in the past/present).

He knew he had duped them (same as Miles and Peter and all the others before).

He would continue on, as long as he was living. This is Japan, and they couldn't touch his money after he got it from the 'stupid fruit pickers' (Marks name for Gaijin in Japan)

Until Larry Kings court case…

Scratch that, not 'first taste' of Karma. He had been fired from the import-export Embroidery Company before that. It was the second taste of Karma for him.

Larry King
(According to Mark, and what else I've learnt since.)


Larry King came into the system on exactly the same day as myself in Jun 2003.

He was the smartest of the customers to date. (Take a hint from this everyone, its critical)...

Larry had used good legal counsel to make, and amend his contract before he paid his money to Smith.

He was to pay 125,000USD in total. It was to be paid in installments of 25,000USD per payment.

Again I stress to you readers..

Larry kept ALL paperwork, emails and correspondences as well as contracts.

IF you are going to part with money, take this advice. It's cost me personally 1,000,000yen in cash to learn this lesson!!!!

Again: YOU MUST USE good legal counsel to make, and amend YOUR contract before YOU PAY YOUR money to Smith.

YOU MUST keep ALL paperwork, emails and correspondences as well as contracts.

YOU MUST not believe one word that comes from Mark Smith's mouth. It is purely, PURELY to get your money.

GET him to write things down....ALWAYS

Seek legal counsel BEFORE AND DURING. Watch your back AFTER. If you don't have lots of money for legal counsel before and after SMITHS, don't even look at it.

Mark showed me (IDIOT that he is) the photos taken by HIS Private Investigator of Larry during legal proceedings.

He (Mark) bragged that:

"I will get photos of him doing something dodgy, hopefully cheating on his wife. Then, we it looks like he will win in court, I will send the photos to his Wife"

Mark Smith's thinking ladies and gentlemen. Is this the person you want to invest in?
Larry and I had training at the same time at Kyobashi head office of Smith's School of English Japan in 2003.

Mark himself pushed Donovon aside to do the curriculum and administration training.
He put a tiny tape recorder on top of one of the partition walls to record every word said.

Sitting in front of Mark, Larry and I represented to him:

A. 35,000USD in cash in the bank already, and

B. Potential legal problems in the future, given Marks business ethics.


Larry was the 'Master Franchiser of Tokyo and Yokohama Smiths School of English'.

I was the next CEO (or whatever it's called by Mark at the time) of Smiths School of English Japan.

At that time, Mark was already involved with two other legal proceedings from ex-customers.

They couldn't get the promised product from Mark that they had payed for (an ongoing saga)

But eventually Larry King wins an award of approximately $50,000 USD from Smith for Mark’s failing to keep to their agreement.

And Smith continues with same business philosophy as he has…
